WHAT IS PROBATE?

Probate, to explain simply, is the legal process in which the Court oversees the appointment of a personal representative who is responsible for gathering the deceased person’s assets and distributing them to pay creditors and administration expenses before final distribution to the beneficiaries. It can involve the admission of a Will, which is a testate estate, or no Will, known as an intestate estate. Chapter 733 of the Florida Statutes, titled “Administration of Estates” sets forth the legal rules and procedures by which a Florida Probate Administration occurs.
